This statement discloses the privacy practices that apply to the online collection of data obtained on www.sybase.com, owned and operated by Sybase, Inc. Sybase, Inc. abides by the principles within the Safe Harbor Program framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union.

What personally identifiable information does Sybase collect from you?

Certain activities on our Web site require the collection of personally identifiable information. Typically, we will collect only your name, company name, email address and other contact information such as phone and fax numbers. When you make a purchase, we will also collect your credit card, billing and shipping information.

We may also ask you for your interests and preferences to customize your future visits to our Web site. Sybase collects information in several ways from different parts of the Sybase.com Web site. These include:

If you choose not to provide the information we request, you can still visit most of Sybase Web site, but you may be unable to access certain options, offers, downloads, and services.

Any newsgroup that begins with Sybase.public or Powersoft.public is a newsgroup that is actively monitored by Sybase. Disclosing personally identifiable information online through chat rooms, forums, and message boards makes the information submitted public information. Such disclosure may increase your chance of receiving "spam" or unsolicited mail. Be extra careful and use your discretion when disclosing information online.

If you choose to use the 'Email this' feature included in certain sybase.com pages to refer articles to other users, we will ask you for the recipient's name and email address. The system will then send an email to the recipient automatically with a link back to the article. Sybase does not store this information, which is needed for the sole purpose of sending a one-time email to the person you designate.


What are cookies and how they are used?

What are cookies? Cookies are used for setting a key on a user's browser that links him/her to the current state of their Web session. Their purpose is to let us know when you visit our site, where you visit in the site, and save preferences you set. Your browser can be set to notify you when you are sent a cookie, giving you the chance to decide whether or not to accept it. If you choose not to accept cookies, you may not have access to certain functionality on our site. Site functionality requiring a login will utilize cookies. As a result, if you would like to visit the logged in portion of the sybase.com site, you will need to accept cookies.

With whom may your information be shared?

Service Providers
We sometimes hire companies (Service providers) to provide services on our behalf. Service providers may provide mailing and event registration information or technical support information to you. We will only provide such service providers the information they need to deliver the services and they are prohibited from using that information for any other purpose.

On occasion, Sybase uses Web site framing techniques, linking you to another service provider's Web site that retains the look and feel and navigation of www.sybase.com. This practice is used simply to aid you to easily navigate back to www.sybase.com. When framing occurs, the URL in your browser's toolbar will no longer display the www.sybase.com address, but the Web site address of the service provider in question.

Companies Offering Promotions
From time to time, a Sybase business partner may wish to offer promotions. Sybase and its partners may engage in events or provide bundled products. In those instances, we will share your information with that partner. Intermediaries
We may also share your information with intermediaries such as credit card companies or banks. Intermediaries serve solely as links in the distribution chain, and do not store, retain, or use the information other than to process a transaction.

Legal Obligations
We may disclose your personal information to another party, such as law enforcement officials, in order to comply with legal requirements, court orders, government or law enforcement agency requests, to protect or defend Sybase, or where we perceive an immediate danger of death or serious physical injury to someone as a result of activity on our Web sites. How does Sybase use the personally identifiable information that has been collected?

From the MySybase portion of the site, we provide Web site visitors with the opportunity to opt-out of receiving electronic notifications from www.sybase.com at the point where we request information about you.

During registration for a MySybase account or creation of an e-Shop billing address or order, you can opt out from the following:

You can access http://response.sybase.com/forms/emailcenter-sybase to add your name and email to the Sybase email suppression list, or http://response.sybase.com/forms/emailcenter-ias to add your name and email to the iAnywhere suppression list. Please note: using these addresses will remove your contact information from general Sybase or iAnywhere electronic communications, respectively; it will not delete your MySybase account.

If you have subscribed to one of our electronic newsletters, you can choose to unsubscribe yourself at any time by following the specific instructions found at the footer of the electronic newsletter.

You can also opt-out of e-mail based marketing campaigns via the unsubscribe option contained in the e-mail invitation. As an alternative, you can also use the opt out link included in this privacy policy statement to add your name to the e-mail suppression list.

However, there are a few circumstances where you will receive email information from us relating to a product or service you requested. You will not be able to choose to opt out of these mailings since they are an essential part of the service you have chosen. These include:

  • Confirmation upon registration of a MySybase account (as well as replies to specific requests by you for edit/forgot password)
  • Specific requests initiated by you using online feedback
  • Event, seminar, teleseminar and/or training registrations
  • Critical product information (End of Life notices, EBF or defects)
  • Specific contest information outlined in contest rules
  • Technical support cases you logged online
  • E-Shop automated order cancellation notices

What kind of security precautions are in place to protect the loss, misuse, or alteration of your information?

Your account and personal information are password-protected so that you and only you have access to this information. You may edit your personal information by using your ID and password. Although we cannot ensure or warrant the security of any information you transmit to us or collected from our online products or services, Sybase has taken strong measures to protect the security of this information and to ensure that your choices for its intended use are honored. We continue to make every effort to protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction. Data quality and the security of customer information is communicated throughout the organization as part of HR & IT policy. Access to customer data is limited to individuals within the Sybase Customer Service, Telesales, and Data Quality teams.


How is your credit card information secured?

When purchasing on e-Shop your transaction and credit card information are secured using Secure Socket Layer (SSL) technology and Verisign's Digital ID Certificates. Credit Card information is only kept in e-Shop and our internal customer order entry system. In the internal data entry system, the data field is encrypted. Sybase secures data in e-Shop by not letting individuals besides the order administrators have access to the information. Our Web security is monitored by our security team continuously.

How can you access, delete or deactivate MySybase account information and personal profile?

At any time, Sybase provides you with an opportunity to correct or change the information collected during registration for MySybase. This can be done in the 'My Account' area of MySybase. Users may change this information at any time and as often as necessary. Also, you can contact portal_helpdesk@sybase.com to access or edit your information if you have trouble accessing your account, or request to have your MySybase account deactivated. If you do not have a MySybase account, you can still contact portal_helpdesk@sybase.com with questions on your online registrations. It may take up to 10 business days to respond to your request for access or obtain complete deactivation of your MySybase account.
